Terms and Conditions
These terms govern your use of homely.je, which is operated by Granite Digital. The most important of them is section 4: every fact about a property on this site was published by the estate agent advertising it, and we do not verify any of it.

1.Who we are, and what you are agreeing to
homely.je (the Website) is owned and operated by Granite Digital (we, us, our), a business registered in Jersey under company number 36294.
By accessing or using the Website you agree to these Terms. If you do not agree to them, please do not use the Website. Our Privacy Policy forms part of these Terms.
2.Definitions
- “Agent”
- an estate agent, letting agent, developer or other business advertising property in Jersey on its own website.
- “Listing”
- a record on the Website describing a property, assembled from what an Agent published on its own website.
- “Listing Information”
- everything a Listing states about a property, including its price, description, photographs, floorplans, address, measurements, tenure, residential qualification, and availability.
- “Content”
- everything on the Website that is not Listing Information — our text, design, software, guides and tools.
- “User”
- anyone who accesses or uses the Website, whether or not they hold an account.
3.What Homely is, and what it is not
3.1An index
The Website is an index of residential property advertised in Jersey. We read Agents’ own public websites and republish what they advertise, in one place, searchable. Today that is 1,648 properties currently advertised across 40 agencies, and it is not the whole island.
3.2Not an agent, and not a party to anything
We are not an estate agent, letting agent, broker, valuer, surveyor, financial adviser or lawyer. We are not instructed by any Agent or by any seller, buyer, landlord or tenant. We do not market property, conduct viewings, take or hold deposits, negotiate, or take any part in a transaction. Any dealing that follows from something you saw here is between you and the Agent, and we are not a party to it.
3.3No relationship with the Agents we index
Unless a Listing says otherwise, we have no commercial relationship, agreement or affiliation with the Agent whose property it describes. Appearing on this site is not an endorsement by us of that Agent, and it does not imply that the Agent endorses, sponsors or is associated with us. We are paid nothing by Agents and receive no commission or referral fee of any kind.
3.4Not a complete picture of the market
We index the Agents we have built support for, and no more. Some Jersey agencies are not on the site at all — because we have not reached them yet, because their website asks crawlers not to read it, or because they have asked to be removed. Absence from this site means nothing about a property or an agency.
4.Listing Information: where it comes from, and what we do not claim
4.1It is the Agent’s information, reproduced
All Listing Information originates from the Agent advertising the property, taken from that Agent’s own public website. Property descriptions are the Agent’s own words, stored and shown as written; we never write, rewrite, summarise, paraphrase or generate text about a property. Prices, photographs, floorplans, measurements and every other stated fact are likewise the Agent’s.
We are not the author or the source of Listing Information and we make no representation or warranty about it of any kind — not as to its accuracy, completeness, currency, legality or fitness for any purpose. Every Listing names its Agent and links to the original advert, which is the authoritative version.
4.2We verify nothing
We do not check, verify, inspect, value, survey or confirm anything in a Listing. We do not visit properties. We do not confirm that a property exists, that the Agent is instructed to market it, that the price is current, that the measurements are right, that the photographs are of that property, that the tenure is as stated, or that anyone is legally entitled to occupy it. Nothing on the Website has been verified by us unless the Website itself says so in terms.
4.3A Listing is a snapshot, not a live feed
The Website is not connected to any Agent’s system and does not update in real time. Records are refreshed by a crawl that runs periodically. Between two crawls, an Agent’s own page may change while ours does not — so a Listing can show a price that has moved, a property that has gone under offer, or a description that has been rewritten.
Each Listing carries the date it was last read, and that date is the truthful statement of how current it is. Treat every figure as being from that date rather than from today.
4.4Some records are only partial
Where a Listing has not yet been read in full, the Website says so — a record is marked as complete or partial, and a partial record shows only what the Agent’s search results page carried. On a partial record the absence of a floorplan, a description or a location does not mean the property has none; it means we have not opened the advert yet. The Website distinguishes the two, and the distinction should be read rather than assumed away.
4.5Some values we worked out rather than read
Most of what a Listing states was published by the Agent in a field of its own. A minority was not, and was derived by us from what the Agent wrote. Derived values are more likely to be wrong than published ones, and the Website flags them. They are:
- Parish. Where an Agent does not publish a parish in a field, we resolve one from the address. We match only against the twelve parishes and record no parish at all rather than guess.
- Features and amenities. Most Agents publish no structured list, so feature filters are matched from the wording of the Agent’s description. They mean the Agent mentioned it, not that the property has it — and a property whose description does not mention a garden is not a property without a garden.
- Facts lifted from prose. Occasionally a figure such as a floor area appears only in the Agent’s description and not in any field. Where we extract one we record that it came from prose and how confident we are, and low-confidence values are kept out of filters.
- Time on the market. Where an Agent publishes no listing date, any age we show is counted from the day the property first appeared on their index while we were watching it — our observation, not the Agent’s statement. Where we cannot say honestly, we show nothing.
- Price changes. A reduction or increase shown on the Website is the difference between two prices we recorded on two different days. It is our record of what the Agent advertised, not a statement by the Agent that the price has changed.
4.6Where an Agent said nothing, we say nothing
We never fill a gap with a plausible value. Where an Agent does not publish a property’s tenure, residential qualification, licence status or location, the Website states that it is not known rather than guessing. This matters most for residential qualification, which decides who may lawfully occupy a property: “not stated” on this site means the advert did not say, not that the property is unrestricted. Ask the Agent.
4.7“No longer available” is our inference
When a property we hold stops appearing on its Agent’s website, we conclude it is no longer being advertised, hide it from search results, and keep its page working for fourteen days with a notice on it before it stops resolving. That notice states both the conclusion and the observation behind it — that the Agent removed the listing on a given date.
That is an inference and it may be wrong. A property can disappear from an Agent’s website because it sold, because it was withdrawn, because the instruction moved to another agency, or because their website changed. Nothing on this site should be read as a statement that a particular property has been sold or let.
4.8What you must do before acting
You must independently verify anything on this Website that matters to you, with the Agent, before relying on it. That includes the price, the availability, the measurements, the tenure, the residential qualification, the rental licence, and whether the property is still on the market at all. You should also take your own professional advice — legal, financial and survey — before committing to any transaction.
To the fullest extent permitted by law, we accept no liability for any loss arising from reliance on Listing Information. Section 13 sets out the limits of our liability in full.
4.9Telling us something is wrong
If you spot something on the Website that is wrong, please tell us at info@homely.je and we will look at it. Where the error is ours — we read the Agent’s page incorrectly — we will fix it and, if the fault is systematic, fix it for every affected Listing. Where the Agent’s own advert says what we are showing, the correction has to be made by the Agent, and we will tell you that rather than change what they published.
5.Photographs, floorplans and agency marks
Photographs, floorplans and logos belong to the Agent that published them or to their licensors, and are shown on the Website to identify and illustrate the property they were published with. We hold our own copies so that pages load reliably and so that we are not consuming an Agent’s bandwidth on every page view, but we do not alter them: no watermark is burnt into an image, and no image is edited. Where a Listing carries an agency logo, it is there as attribution — to say whose advert this is — and not as a claim of association.
If you own rights in any image on this site and would like it removed, write to info@homely.je and we will take it down.
6.Estate agents: corrections, opt-out and takedown
This section is addressed to Agents. If you are an Agent whose listings appear on the Website and you would rather they did not, you do not need to instruct anyone, threaten anything, or explain why. Write to info@homely.je from an address at your agency’s domain and say so.
- We will acknowledge your request within 2 working days.
- We will stop crawling your website immediately on receipt, and remove your listings from public display on the Website within 5 working days.
- We will delete our copies of your photographs and floorplans within 30 days.
- If you would rather stay on the Website but have something corrected — a listing we have read wrongly, a negotiator’s contact details removed, a property taken down — tell us which and we will do that instead.
Our crawler identifies itself as HomelyBot, reads and honours robots.txt on every request, requests pages no faster than one per second, and does not attempt to reach anything behind a login or a paywall. Disallowing it in your robots.txt has the same effect as emailing us, and takes effect on our next crawl.
7.Our guides and tools are not advice
The Website carries a stamp duty calculator and written guides, including one on housing qualifications. They are general information about Jersey property, published in good faith and kept as accurate as we can.
They are not legal, financial, tax or professional advice, and must not be relied on as such. The stamp duty calculator produces an estimate from the rates published by the Government of Jersey, on the assumptions the page states; your actual liability depends on facts about you and the transaction that we do not hold, and rates change. Confirm any figure with your lawyer, lender or the Government of Jersey before relying on it.
8.Accounts, saved properties and saved searches
8.1Your account
You can use the whole of the Website without an account. If you create one, you agree to give accurate information, to keep your password confidential, and to tell us at info@homely.je if you think someone else has used it. You are responsible for what happens under your account. You must be 18 or over to create one.
8.2Saved searches do not notify you
Saved searches are bookmarks. We do not currently send email or push alerts of any kind, and no saved search will tell you when a matching property appears. The Website says so wherever a search can be saved, and we say it here too, because a saved search that quietly notified nobody would be the one thing this site could not afford to get wrong. If we build alerts, they will be opt-in.
8.3Closing an account
You can close your account at any time by writing to info@homely.je. We may suspend or close an account that breaches these Terms, or where we are required to by law. What happens to your data is in the Privacy Policy.
8.4The Website is free
The Website is provided free of charge and there is nothing to pay. If we ever introduce a paid feature, it will be optional, priced before you commit to it, and it will not place anything that is free today behind a charge without notice.
9.Acceptable use
You agree not to:
- scrape, harvest, crawl, index, copy or systematically extract Listing Information or other Content from the Website, by any means, without our prior written consent;
- use the Website or anything on it to build or supply a competing product, database or data feed;
- use Listing Information to market to, contact or build a list of the Agents, negotiators or individuals named on the Website;
- place an unreasonable load on the Website, interfere with its operation or security, or attempt to gain access to any part of it you have not been given access to;
- reverse engineer, decompile or attempt to extract the source code of the Website; or
- use the Website for any unlawful purpose, or in breach of anyone’s rights.
We may suspend or block access to anyone who breaches this section, and may take further action where the breach causes us or an Agent loss.
10.Intellectual property
The Website, its design, software, guides, tools and text — everything other than Listing Information — belongs to Granite Digital or its licensors, and is protected by copyright, database right and other rights. The Homely name and mark are ours.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Website for your own personal, non-commercial property search, subject to these Terms. Nothing in that licence permits the extraction or reuse prohibited by section 9.
Rights in Listing Information, including photographs, floorplans, descriptions and agency marks, remain with the Agent or their licensors. Nothing on the Website transfers them, and nothing in these Terms grants you any right to reuse them.
11.Links to other websites
Every Listing links to the Agent’s own website. We do not control those sites, are not responsible for their content, availability or practices, and a link is not an endorsement. Once you follow one you are subject to that site’s own terms and privacy policy.
12.Availability of the Website
The Website is provided on an as is and as available basis. It is in beta. We do not warrant that it will be uninterrupted, timely, error-free, secure, or free from harmful components, and we may change, suspend or withdraw any part of it — including any Listing, guide or tool — at any time and without notice.
13.Disclaimers and limitation of liability
13.1What we do not warrant
To the fullest extent permitted by law, we exclude all warranties, conditions and representations of any kind, express or implied, including as to accuracy, completeness, currency, quality, fitness for a particular purpose and non-infringement. In particular, and without limiting section 4, we do not warrant or guarantee:
- the accuracy, completeness or currency of any Listing Information;
- that any property described on the Website exists, is available, or is being lawfully marketed;
- that any price, measurement, floor area, tenure, residential qualification, licence status or location shown is correct or current;
- that a property shown as available has not been sold, let, withdrawn or reduced;
- that a property shown as no longer available has in fact been sold or let;
- the identity, competence, solvency, conduct or good faith of any Agent; or
- that the Website covers every property advertised in Jersey.
13.2No liability for reliance on Listing Information
To the fullest extent permitted by law, we are not liable for any loss or damage of any kind arising from your reliance on Listing Information, or from any inaccuracy, omission, error, staleness or absence in it. That includes any loss arising from a price that had changed, a property that was no longer available, a measurement that was wrong, a residential qualification or tenure that was not as stated, or a property that never appeared on the Website at all. The Agent’s own advert is the authoritative source and section 4.8 tells you to check it.
13.3No liability for dealings with Agents
We are not a party to and take no part in any transaction, negotiation, viewing, tenancy or contract between you and an Agent or anyone they act for. We accept no liability for anything arising out of one, including any loss, dispute, misdescription or fraud.
13.4Excluded loss and the cap
To the fullest extent permitted by Jersey law, Granite Digital and its officers, employees, contractors and agents are not liable to you for any:
- loss of profit, revenue, business, opportunity or anticipated savings;
- loss of goodwill or reputation;
- loss of data;
- loss arising from a property transaction, or the failure of one, however caused; or
- indirect, consequential, special or exemplary loss.
Our total aggregate liability to you for all claims arising out of or in connection with these Terms or your use of the Website, whether in contract, tort (including negligence), breach of statutory duty or otherwise, will not exceed the greater of (a) £100, or (b) the total amount you have paid us in the twelve months before the event giving rise to the claim.
13.5What we do not exclude
Nothing in these Terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation; or
- anything else that cannot lawfully be excluded or limited under Jersey law.
If you are a consumer, nothing in these Terms affects your statutory rights that cannot be waived or limited by agreement.
14.Indemnity
You agree to indemnify and hold harmless Granite Digital, its officers, employees and agents against any claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Website, your breach of section 9, or your violation of any law or of anyone’s rights. This clause survives your ceasing to use the Website.
15.Force majeure
We are not liable for any failure or delay in performing our obligations under these Terms where it results from causes beyond our reasonable control, including act of God, war, terrorism, civil unrest, government action, pandemic, fire, flood, storm, power failure, internet or telecommunications outage, third-party service failure or industrial action.
16.Changes to these Terms
We may change these Terms. The date at the top moves when the text does, and it is set by hand rather than by a deployment, so it means the day the wording last changed. For material changes we will give reasonable notice by a prominent notice on the Website or, if you have an account, by email. Continuing to use the Website after a change takes effect means you accept the revised Terms.
17.General
17.1Entire agreement
These Terms and the Privacy Policy are the entire agreement between you and us about the Website, and replace anything said or written before.
17.2Severability
If any provision is found to be invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable or, failing that, severed. The rest stays in force.
17.3No waiver
If we do not enforce a right or provision, that is not a waiver of it. A waiver is effective only if given in writing.
17.4Assignment
You may not assign or transfer your rights under these Terms. We may assign them to a successor or affiliate.
17.5No third-party rights
Except as expressly stated, nothing in these Terms gives any right or benefit to a third party under the Contracts (Rights of Third Parties) (Jersey) Law 2002.
17.6Notices
Legal notices to us must be sent to info@homely.je. We will give notice to you by email to the address on your account, or by a notice on the Website.
17.7No partnership
Nothing in these Terms creates any agency, partnership, joint venture or employment relationship between you and us.
18.Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), are governed by the law of Jersey, Channel Islands. The courts of Jersey have exclusive jurisdiction, save that nothing prevents us from bringing proceedings to protect our intellectual property in any jurisdiction.
Before starting proceedings, please contact us at info@homely.je so we can try to resolve the matter. We will respond within 30 days. This does not affect your right to go to court at any time.
